Terms of Sale

By placing an order you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.

Dispatch times may vary according to availability and subject to any delays resulting from postal delays or force majeure for which we will not be responsible.

(a) Our Contract

In order to contract with raybeammakes.co.uk you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us. raybeammakes.co.uk retains the right to refuse any request made by you. If your order is accepted we will inform you by email. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorized user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods. The cost of foreign products and services may fluctuate. All prices advertised are subject to such changes.

(b) Pricing and Availability

Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. In this instance if you cancel and you have already paid for the goods, you will receive a full refund.

(c) Payment

Upon receiving your order we carry out a standard authorization check on your payment card to ensure there are sufficient funds to fulfil the transaction. Your card will be debited upon authorisation being received. The monies received upon the debiting of your card shall be treated as a deposit against the value of the goods you wish to purchase. Once a confirmation email has been sent the monies paid as a deposit shall be used as consideration for the value of goods you have purchased as listed in the confirmation email.

Product Usage

We only supply the Product and Services for domestic and private use. You agree not to use the product for any commercial, business or re-sale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

Force Majeure

The Seller shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the Seller shall be entitled to a reasonable extension of its obligations. If the delay persists for such time as the Seller considers unreasonable, it may, without liability on its part, terminate the contract.

Disclaimer of Liability

No liability of any nature shall be Incurred or accepted by the Seller in respect of any representation made by the Seller, or on its behalf, to the Buyer, or to any party acting on its behalf, prior to the making of this contract where such representations were made or given in relation to:

the correspondence of the Goods with any description;

the quality of the Goods; or

the fitness of the Goods for any purpose whatsoever.

No liability of any nature shall be accepted by the Seller to the Buyer in respect of any express term of this contract where such term relates in any way to:

the correspondence of the Goods with any description;

the quality of the Goods; or

the fitness of the Goods for any purpose whatsoever.

All implied terms, conditions or warranties as to the correspondence of the Goods to any description or the satisfactory quality of the Goods or the fitness of the Goods for any purpose whatsoever (whether made known to the Seller or not) are hereby excluded from the contract.

Linking to this Website

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link from any website that is not owned by you. This Website must not be framed on any other site, nor may you create a link to any part of this Website other than the home page. We reserve the right to withdraw linking permission without notice.

Delivery of goods

We currently ship all orders via 1st Class Royal Mail to the UK only.

Shipping is calculated at checkout and is to be paid for by the buyer.

As orders are made to order I would expect order to take between 1-2 weeks. You will receive an email when I have posted the order and should then expect the delivery between 2-3 days from that email.

Cancellation and Refunds

Most of our items are personalised and custom-made items are bespoke and made to order and are therefore exempt from the Consumer Contract Regulations 2014. If orders have been made specifically for you and we are unable to store or resell the item, we will not be able to offer a refund. Even our non-personalised items are considered custom made orders as we do not have space to store stock and our items are made to order.

If an item is one of our frequently made items you may be entitled to a refund under the Consumer Contracts Regulations. Under the Consumer Contracts Regulations, if you change your mind about a purchase you have made within 14 working days after the date of delivery, you are entitled to a full refund of the original purchase price for the goods or services you wish to return, and the original postage and packaging charges made. You will not be entitled to a refund of the cost you incur in returning the item to us.

To be eligible for a return, your item must be unused and in the same condition that you received it, and it must be in the original packaging.

If you have been offered a refund you will need to return the order in its original packaging within 14 days of the time that you informed us that you wish to return the order. You will receive a refund within 14 days of us receiving the order back.

Complaints

We operate a complaints handling procedure which we will use to try to resolve disputes when they first arise, please let us know if you have any complaints or comments

Waiver

If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.

Entire Agreement

The above Terms of Service constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and raybeammakes.co.uk. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by a Director of raybeammakes.co.uk.
